Fallon Lynskey Dispute

Fallon Lynskey Dispute

June 6, 1927 - Castledaly, Galway, Ireland
Before Mr, Naish, acting D.J., at Gort Court on Saturday, Mrs. Mary Lynskey, an old lady, of Seariff, Castledaly, was charged with malicious wounding a donkey, the property of Mrs. Julia Fallon, same place, by stabbing it with a four-pronged fork. Patrick Linnane, her brother, of Scalp, Castledaly, was also charged with aiding and abetting defendant in the act. Michael Fallon, complainant's son,. stated that Mrs. Lynskey called him while he was passing by her house, and showed him the donkey she had tied to the door of the kitchen. He took the donky away and when he got home he noticed it lame. Defendant: I gave the donkey up to you five times before this. Agnes Fallon, sister of last said she saw blood running from wounds on the donkey's back. Asked by defendant if she saw her injuring the donkey, the witness said no. Mrs. Julia Fallon said the donkey was four years old. She saw it after it came from Mrs. Lynskey's, and-saw little holes on the donkey, as if caused by a fork. She went to the accused and asked her who wounded the donkey, and she said: "You will mind him the next time." Sergeant O'Neill stated defendant made a statement that she did nothing to the donkey. Patrick Linnane, when charged, said he found the donkey in the garden and there were no wounds on it. Witness, continuing, said there were 24 wounds on the donkey. Some of the wounds were six inches long. The holes in the donkey's back were, in his opinion, caused by a four-pronged fork. He examined the distances from prong to prong and he found they corresponded with the holes in the donkey. Mrs. Lynskey said she did not injure the donkey. She was annoyed by the trespass of the donkey, and she gave him up five times before that to Mrs. Fallon and told her that she would summon her for trespass. Patrick Linnane stated that he did not injure the donkey either. Asked by the Supt, in cross-examination how he thought the wounds were caused, he said they may have been caused by fencing wire in the field. He was on his oath in the court, and he denied the statement he made to the sergeant that h tied up the donkey. The Superintendent said that the evidence he relied on was that Linnane told the sergeant that he brought the donkey to Mrs. Lynskey's house and tied it up. The donkey was savagely wounded and was not fit to work yet. The District Justice imposed a fine of 1 Pound on Mrs Lynskey, as compensation and discharged Linnane.
