Eleanor and Thomas Walker Land Sale
May 18, 1846 - Licking County, Ohio
Know all men by these presents that we, Thomas Walker and Eleanor Walker, wife of said Thomas Walker of the County of Licking and State of Ohio, in consideration of the sum of Four hundred dollars in hand paid by George W. Smith of said County and State, have bargained and sold and by these presents do grant, bargain, sell, and convey unto the said George W. Smith, his heirs and assigns forever, the following premises situate in the County of Licking and State aforesaid and bounded and described as follows: to wit:
Being part of the northwest quarter of section thirty-three, township four, range eleven, United States Military lands, and bounded as follows, to wit: Beginning at the southwest corner of said quarter section; thence north seventy-five poles to a stone; thence east seventy poles to a stone; thence south seventy-five poles to a stone on the south boundary of said quarter section; thence west seventy poles to the place of beginning, containing thirty-two acres more or less.
To have and to hold said premises with the appurtenances unto the said George W. Smith, his heirs and assigns forever. And we, the said Thomas Walker and Eleanor Walker, for ourselves and for our heirs, executors, and administrators, do hereby covenant with the said George W. Smith, his heirs and assigns, that we are lawfully seized of the premises aforesaid, that the premises are free and clear from all encumbrances whatsoever, and that we will forever warrant and defend the same with the appurtenances unto the said George W. Smith, his heirs and assigns, against the lawful claims of all persons whomsoever.
And the said Eleanor Walker, wife of the said Thomas Walker, does hereby remise, release, and forever quit claim unto the said George W. Smith, his heirs and assigns, all her right and expectancy of dower in the said premises.
In witness whereof we have hereunto set our hands and seals this 18th day of May in the year of our Lord 1846.
Now if the Thomas Walker shall pay the said several sums of money to said Thomas Smith as shall become due when the same respectively become due as above mentioned without any deduction or fraud then this mortgage shall become null and void otherwise to remain in full force. In testimony whereof the said Thomas Walker and Eleanor Walker have hereunto set their hands and seals this 18th day of May AD 1846.

Before me Jacob Miller a Justice of the Peace within and for said County personally appeared the said Thomas Walker and Eleanor Walker his wife and acknowledged the signing and sealing of the above conveyance to be their voluntary act and deed and the said Eleanor Walker being at the same time examined by me separate and apart from her said husband and the contents of said instrument made known to her on such examination declared that she did voluntarily sign seal and acknowledge the same, and that she is still satisfied therewith.

Mortgage dated 27 May 1836. Consideration $1000.
Witnesseth that Whereas, the said Thomas Walker hath become bound unto the said Powell De Hart in the penal sum of one thousand dollars, by his certain bond bearing date the twentieth day of March in the year of our Lord one thousand eight hundred and thirty, conditioned that the said Thomas will clearly indemnify and save harmless the said Powell Dehart of and from any claims and demands which may be made against certain lands and premises, conveyed by him to the said Powell Dehart by or on behalf of the children of the said Thomas and Ellen his wife or any or either of them, arising out of or founded upon the will & statement of Nicholas Borden dec'd.
Now this Indenture Witnesseth that the said Thomas Walker and Ellen his wife for the better security of the said Powell Dehart in the premises and for the further consideration of the sum of one dollar to them in hand paid &c. have granted &c. all that tract or parcel of land and premises, situate lying and being in the Township of North Brunswick, County of Middlesex and State of New Jersey and on the south side of Lawrence Brook. Beginning at a small hickory saplin on the bank of said brook, thence running up said Brook to the bridge, across said brook, thence south fifty one degrees east, seven chains sixty three links, to a cedar tree thence south thirteen degrees and fifteen minutes west to the road, thence along the road the several courses, thereoff to a small white oak tree in Simmons line; thence north forty degrees and thirty minutes east, thirty four chains and twenty links along Simmons line to a white oak sapling for a corner thence along the line of Benjamin Ruthill north forty one degrees and thirty minutes west thirty six chains and fifty links to the beginning. Containing one hundred and two acres saving and reserving twenty one acres and ninety six hundredths of an acre conveyed by Cornelius Dehart, & Ida his wife to David Freeman and Aaron Hassert as by reference to their deed will fully appear;
Together &c. To Have and to Hold &c. Provided &c. that if the said Thomas Walker his executors or administrators shall well and truly comply with and perform the conditions of the above recited bond, or obligation or in case he fail so to do that he pay to the said Powell Dehart his heirs or assigns the penalty mentioned and expressed in the said obligation that then &c. In Witness &c.

Mortgage dated December 25th, 1805
This Indenture made the twenty-fifth day of December in the year of our Lord one thousand eight hundred and five, between Thomas Walker of the Township of Brunswick in the County of Middlesex and State of New Jersey, and Eleanor his wife, of the one part, and Stephen Williams of the same place, of the other part.
Whereas the said Thomas Walker and Eleanor his wife stand justly indebted to the said Stephen Williams in the sum of five hundred and fifty-five dollars and fifty-five cents lawful money of the United States of America, secured to be paid by a certain bond or obligation bearing even date herewith.
Now this Indenture Witnesseth, that the said Thomas Walker and Eleanor his wife, as well for and in consideration of the said debt or sum of five hundred and fifty-five dollars and fifty-five cents, and for the better securing the payment thereof with lawful interest thereon, according to the true intent and meaning of the said bond or obligation, as for and in consideration of the sum of one dollar to them in hand paid by the said Stephen Williams at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, released, conveyed, and confirmed, and by these presents do grant, bargain, sell, alien, release, convey, and confirm unto the said Stephen Williams, his heirs and assigns, forever, all that certain tract or parcel of land situate, lying, and being in the Township of Brunswick, County of Middlesex, and State of New Jersey.
Beginning at a certain stone set for the southeast corner of the said land and running thence north seventy degrees west, thirty-eight chains and thirty-four links to a stake at the side of the road; thence south ten degrees west, twenty-eight chains to a post; thence south seventy degrees east, thirty-eight chains and thirty-four links to a stake at the southeast corner; thence north ten degrees east, twenty-eight chains to the place of beginning, containing one hundred and twenty acres, more or less, together with all and singular the hereditaments and appurtenances thereunto belonging or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues, and profits thereof, and all the estate, right, title, interest, claim, and demand whatsoever, of them the said Thomas Walker and Eleanor his wife, in law or equity, of, in, and to the same and every part and parcel thereof.
To Have and to Hold the said granted and bargained premises, with the appurtenances, unto the said Stephen Williams, his heirs and assigns, to the only proper use, benefit, and behoof of the said Stephen Williams, his heirs and assigns forever. Provided always, and these presents are upon this express condition, that if the said Thomas Walker, his heirs, executors, or administrators, shall well and truly pay, or cause to be paid, unto the said Stephen Williams, his heirs, executors, administrators, or assigns, the aforesaid debt or sum of five hundred and fifty-five dollars and fifty-five cents, with lawful interest for the same, on or before the twenty-fifth day of December next ensuing the date hereof, according to the condition of the said bond or obligation, then and from thenceforth these presents and everything herein contained shall cease, determine, and be utterly void to all intents and purposes.
