Stadden, dec'd, John Park & Rebecca Grace, admins of Peter Grace, dec'd, Rachel Lee, admin of Amos Lee, dec'd, John Baker, admin of Benjamin Baker, dec'd, Samuel Montjoy, admin of Japhet Montjoy, dec'd, and John M. Tunison, admin of Thomas Walker, dec'd, having heretofore filed their accounts and vouchers for final settlement at the present term of this court, and the same having been duly advertised, and no objection being filed to said accounts, it is ordered by the Court that the same be allowed and recorded.

Page 110–111 This Indenture made the nineteenth day of May in the year of our Lord one thousand eight hundred and forty-six, between Thomas Smith and Mary his wife of the one part, and Thomas Walker of the County of Licking and State of Ohio, of the other part, Witnesseth: That the said Thomas Smith and Mary his wife, for and in consideration of the sum of three hundred dollars current money of the United States, granted to them in hand paid, the receipt whereof they do hereby acknowledge, and thereof acquit and discharge the said Thomas Walker, his heirs, executors, and administrators, have granted, bargained, and sold, aliened, conveyed, and confirmed, and by these presents do grant, bargain, sell, alien, convey, and confirm, unto the said Thomas Walker, his heirs and assigns forever, all that certain tract or parcel of land situate, lying, and being in the County of Licking and State of Ohio, and bounded and described as follows, to wit: Beginning at a stone at the northwest corner of the northeast quarter of Section Thirty-three, in Township Four, of Range Eleven of the Refugee Tract; thence south forty poles to a post; thence east one hundred and sixty poles to a post; thence north forty poles to the northern boundary of said quarter section; thence west along said boundary line one hundred and sixty poles to the place of beginning, containing forty acres of land, more or less. To have and to hold the premises hereby granted with all the appurtenances thereunto belonging, or in anywise appertaining, to the only proper use and benefit of the said Thomas Walker, his heirs, and assigns forever. And the said Thomas Smith and Mary his wife, for themselves, their heirs, executors, and administrators, do covenant, promise, and agree to and with the said Thomas Walker, his heirs, and assigns, that they are the true and lawful owners of the premises hereby granted, and have good right and lawful authority to sell and convey the same in manner and form as above written; and further, that they, the said Thomas Smith and Mary his wife, their heirs, executors, and administrators, will warrant and forever defend the premises hereby granted unto the said Thomas Walker, his heirs, and assigns, against all lawful claims and demands of all persons whatsoever. In witness whereof, the said Thomas Smith and Mary his wife have hereunto set their hands and seals the day and year first above written. Thomas Smith [Seal] Mary Smith [Seal] Signed, sealed, and delivered in the presence of: John Mason William Parker State of Ohio, Licking County, ss: Be it remembered that on the nineteenth day of May in the year of our Lord one thousand eight hundred and forty-six, personally appeared before me, John Mason, Judge of the Court of Common Pleas for said county, the above-named Thomas Smith and Mary his wife, and severally acknowledged the signing and sealing of the foregoing deed of conveyance to be their voluntary act and deed. And the said Mary Smith, being by me examined separate and apart from her said husband, and the contents of said deed being fully made known to her, declared that she voluntarily signed, sealed, and acknowledged the same, and that she is still satisfied therewith. A resident of the City of London, England, but who now resides at the City of Troy, New York, who saw the same used by Samuel Wood at Tottenham Court Road in London as aforesaid. Drake and Joseph Drake and John Boroughs at said parish of Gordley in England. Also to Thomas Walker during the years 1826, 1827, and 1828 at a place called Milltown in the Town of New Brunswick in the State of New Jersey, where the said Thomas Walker then resided and manufactured brick according to the methods in the specification annexed to said letters patent in the said plaintiff's declaration mentioned and described. And that said Thomas Walker is now a resident of Kirkersville in the Town of Etna, Licking County, State of Ohio.

Letter Regarding Thomas Walk Brick Maker in New Jersey

Mr. Thomas Walker Dear Sir, I am requested to write to you by Mr. Holbrook of Newark and make the following inquiry: Whether you mixed in your clay hard coal for the purpose of burning brick previous to 1828. Abraham Plep tells me that the brick kiln you ran together by using to match coal you sold to Thompson and they were used for erecting the Dutch Church steeple built in the summer of 1828. I am strongly of the opinion you made use of coal by mixing in your clay in 1826 or 1827. You purchased coal in New York and charged it up by the Washington Shops. I think you bought some coal of H. Bostwick. Martin Howden has entered his books that coal dust was sold to you in the spring of 1830, and thinks he sold you long before that. I wish you to inform me as soon as you become satisfied in your own mind as to the year you mixed hard coal in your clay. It is of now importance to me of great importance to them to ascertain that fact as early as possible. There men will feel under great obligations to you by a recovery of those facts as early as possible. Respectfully yours, Matthew Legerton
